If we cannot supply a product, we will notify you and, where payment has already been taken, refund the relevant amount without undue delay.


7. PRICES

Product prices will be displayed on our website before you place your order.

Prices displayed to UK consumers will include applicable taxes where required by law.

Any mandatory charges that can reasonably be calculated in advance will be disclosed before you place your order.

Delivery charges, where applicable, will be displayed separately before checkout.

We will not intentionally introduce unavoidable mandatory charges only at the final stage of the purchasing process.


8. PRICE ERRORS

If you are a consumer resident in the United Kingdom, these Terms and any contract between you and Emmergrey will be governed by the applicable laws of the United Kingdom, subject to the mandatory consumer protections applicable where you live.

Nothing in these Terms deprives you of mandatory consumer protections available to you under applicable law.


44. JURISDICTION

If you live in:

  • England or Wales, proceedings may generally be brought in the courts of England and Wales;

  • Scotland, proceedings may generally be brought in the Scottish courts; or

  • Northern Ireland, proceedings may generally be brought in the courts of Northern Ireland,

subject to applicable consumer jurisdiction rules.

Emmergrey will not use this clause to prevent a consumer from bringing proceedings in a court available to them under mandatory law.


45. CONSUMER STATUTORY RIGHTS

Nothing in these Terms affects your statutory rights.

Relevant UK legislation may include, depending on the transaction and circumstances:

  • Consumer Rights Act 2015;

  • Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013;

  • Digital Markets, Competition and Consumers Act 2024;

  • Electronic Commerce (EC Directive) Regulations 2002, where applicable;

  • applicable product safety legislation;

  • applicable data protection legislation; and

  • other consumer protection legislation in force from time to time.

If any provision in these Terms conflicts with a mandatory statutory consumer right, the statutory right will prevail.
